Eyefi Limited Warranty & Liability Information

FOR CONSUMERS, WHO ARE COVERED BY CONSUMER PROTECTION LAWS OR REGULATIONS IN THEIR COUNTRY OF PURCHASE OR, IF DIFFERENT, THEIR COUNTRY OF RESIDENCE, THE BENEFITS CONFERRED BY THIS WARRANTY ARE IN ADDITION TO ALL RIGHTS AND REMEDIES CONVEYED BY SUCH CONSUMER PROTECTION LAWS AND REGULATIONS. THIS WARRANTY DOES NOT EXCLUDE, LIMIT OR SUSPEND ANY RIGHTS OF CONSUMERS ARISING OUT OF NON-CONFORMITY WITH A SALES CONTRACT. SOME COUNTRIES, STATES AND PROVINCES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES OR ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY OR CONDITION MAY LAST, SO THE LIMITATIONS OR EXCLUSIONS DESCRIBED BELOW MAY NOT APPLY TO YOU. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS THAT VARY BY COUNTRY, STATE OR PROVINCE. THIS LIMITED WARRANTY IS GOVERNED BY AND CONSTRUED UNDER THE LAWS OF THE COUNTRY IN WHICH THE PRODUCT PURCHASE TOOK PLACE.

Limited Warranty

Eye-Fi, Inc. ("Eyefi") warrants to the original purchaser that this hardware product will be free from defects in materials and workmanship for a period which is the longer of: (a) twelve (12) months from the date of original retail purchase, or (b) the minimum warranty period in the jurisdiction in which the product was purchased.

What We Will Do

If a defect exists, Eyefi will, at its option, replace the product with a product that is new or replace the product with a replacement product that has been manufactured from new or refurbished, serviceable used parts and which is at least functionally equivalent to the original product. If Eyefi is unable to repair or replace the defective product, Eyefi will provide a refund of your purchase price either directly or through the retailer from which you purchased the product. A replacement product is covered by this Limited Warranty for the remaining period of the Limited Warranty of the original product or sixty (60) days from the date of replacement, whichever is longer.

What Is Not Covered

This Limited Warranty applies only to hardware products manufactured by or for Eyefi that can be identified by the "Eyefi" trademark, trade name, or logo affixed to them. The Limited Warranty does not apply to any non-Eyefi hardware products or any software, even if packaged or sold with Eyefi hardware. This Limited Warranty only applies to products purchased from Eyefi or an Eyefi authorized reseller. For a list of authorized resellers, please go here.

Recovery and reinstallation of system and application software and user data are not covered under this Limited Warranty. This Limited Warranty does not apply: (a) to damage caused by accident, abuse, misuse, misapplication, or non-Eyefi products; (b) to a product or a part that has been modified without the written permission of Eyefi; or (c) damage caused by Acts of God or other causes beyond the control of Eyefi.

Limitation of Warranty/Duration of Implied Warranty

THIS WARRANTY AND REMEDIES SET FORTH ABOVE ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, REMEDIES AND CONDITIONS, WHETHER ORAL OR WRITTEN, EXPRESS OR IMPLIED. EYEFI SPECIFICALLY DISCLAIMS ANY AND ALL IMPLIED WARRANTIES, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. IF EYEFI CANNOT LAWFULLY DISCLAIM IMPLIED WARRANTIES UNDER THIS LIMITED WARRANTY, ALL SUCH WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE ARE LIMITED IN DURATION TO THE DURATION OF THIS LIMITED WARRANTY.

No Eyefi reseller, agent, or employee is authorized to make any modification, extension, or addition to this Limited Warranty.

Limitation of Liability

EYEFI IS NOT RESPONSIBLE FOR DIRECT, INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES RESULTING FROM ANY BREACH OF WARRANTY OR CONDITION, OR UNDER ANY OTHER LEGAL THEORY, INCLUDING BUT NOT LIMITED TO LOSS OF PICTURES, VIDEOS, PROGRAMS, DATA OR ANY CONSEQUENCES RESULTING THEREFROM, LOST PROFITS, DOWNTIME, GOODWILL, DAMAGE TO OR REPLACEMENT OF EQUIPMENT AND PROPERTY, ANY COSTS OF RECOVERING, REPROGRAMMING, OR REPRODUCING ANY PICTURES, VIDEOS, PROGRAMS OR DATA STORED IN OR USED WITH EYEFI PRODUCTS, AND ANY FAILURE TO MAINTAIN THE CONFIDENTIALITY OF PICTURES, VIDEOS, PROGRAMS OR DATA STORED ON THE PRODUCT. EYEFI SPECIFICALLY DOES NOT REPRESENT THAT IT WILL BE ABLE TO REPAIR ANY PRODUCT UNDER THIS WARRANTY OR REPLACE A PRODUCT WITHOUT RISK TO OR LOSS OF PICTURES, VIDEO, PROGRAMS OR DATA. EYEFI’S MAXIMUM LIABILITY UNDER THIS WARRANTY IS LIMITED TO THE ORIGINAL PURCHASE PRICE OF THE PRODUCT.

How to Obtain Warranty Service/What You Must Do

For the Eyefi Customer Care department contact phone number, hours of operations and email, please visit http://support.eye.fi. When contacting Customer Care, you must provide "proof of purchase" information to the Customer Care agent to obtain warranty service. You are responsible for all shipping charges associated with shipping the product to Eyefi or Eyefi’s authorized representative. Eyefi is responsible for all shipping charges associated with shipping a replacement product to you.

Disposal & Recycling – Applicable in the European Union and other countries with separate collection systems.

To prevent possible harm to the environment or human health from uncontrolled waste disposal, please separate the Eyefi card and USB Card Reader from other types of wastes and recycle it responsibly to promote the sustainable reuse of material resources.

Household users should contact either the retailer where they purchased this product, or their local government office, for details of where and how they can take this item for environmentally safe recycling. Business users should contact their supplier and check the terms and conditions of the purchase contract.

This product should not be mixed with other commercial waste for disposal.

Recycling Eyefi Card and USB Card Reader

Do not dispose of either the Eyefi Card or USB Card Reader with your household waste. In some countries or regions, collection systems are set up to handle electrical and electronic waste items. Contact your regional authorities for more details. If collection systems are not available, please return unwanted accessories to any Eyefi Approved Service Center in your region.

EMC Information

Changes or modifications to this product not authorized by Eyefi could void the EMC compliance and negate your authority to operate the product. This product has demonstrated EMC compliance under conditions that included the use of compliant peripheral devices and shielded cables between system components. It is important that you use compliant peripheral devices and shielded cables between system components to reduce the possibility of causing interference to radios, televisions, and other electronic devices.

FCC Information

This equipment has been tested and found to comply with the limits for a Class B digital device, pursuant to Part 15 of the FCC rules. These limits are designed to provide reasonable protection against harmful interference in a residential installation. This equipment generates, uses and can radiate radio frequency energy and, if not installed and used in accordance with the instructions, may cause harmful interference to radio communications. However, there is no guarantee that interference will not occur in a particular installation. If this equipment does cause harmful interference to radio or television reception, which can be determined by turning the equipment off and on, the user is encouraged to try to correct the interference by one or more of the following measures:
